CoolDesk AI, a service of Digital Zeta LLC, offers a 24/7 AI lead capture system for HVAC contractors in Florida, including AI voice answering, multichannel AI conversational messaging (SMS, Facebook, Instagram Direct Messages, and Google Business Chat), automated appointment scheduling, a real-time performance dashboard, and related bonuses and add-ons as described from time to time on the Site.

The terms, conditions, pricing, timelines, and guarantees applicable to the engagement of these services are governed exclusively by the Service Agreement signed between Digital Zeta LLC and the client, which prevails over any general information published on this Site.

SMS / TEXT MESSAGING PROGRAM

As part of the Service, CoolDesk AI operates an SMS messaging program on behalf of client businesses. This program is used to send messages related to appointment scheduling, appointment reminders, service follow-ups, and re-engagement of prior leads. Message content, timing, and frequency vary depending on how each client business configures the Service and on customer activity.

Opt-out: Recipients may cancel SMS messages at any time by replying STOP. After sending "STOP," recipients may receive one final message confirming their opt-out, after which they will no longer receive SMS messages, unless they opt back in.

Help: Recipients can reply HELP to any message to receive assistance or contact information for the client business.

Message and data rates: Message and data rates may apply to messages sent and received as part of this program, depending on the recipient's mobile carrier and plan.

Carrier liability: Mobile carriers are not liable for delayed or undelivered messages. CoolDesk AI and Digital Zeta LLC are not responsible for message delivery delays or failures caused by carrier networks or a recipient's device or account settings.

Age restriction: The SMS program, and use of the Site and Service generally, is intended for individuals who are at least 18 years old. By opting in to receive messages or using the Site, you represent that you are 18 years of age or older.

REFUND POLICY

Refunds applicable to services contracted with CoolDesk AI / Digital Zeta LLC are governed exclusively by the terms set out in the Service Agreement signed with each client. In particular, the process-based satisfaction guarantee described in the Service Agreement (for example, a refund of the setup fee if the system is not answering calls and booking appointments as described within the applicable trial period) is detailed in that agreement.

No refunds will be issued for requests that do not meet the conditions and deadlines established in the corresponding agreement.

TERMINATION OF ACCESS

Digital Zeta LLC may suspend or terminate any user's access to the Site at any time and without prior notice, particularly in cases of misuse, breach of these Terms, or when deemed necessary to protect the integrity of the Site or third parties.

GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Republic of Ecuador for users located in that country, and by the laws of the Republic of Peru for users located in that country. For users in other countries, including clients located in the State of Florida, United States of America, the applicable law will be determined in accordance with the terms of the Service Agreement signed between the parties.

Any dispute arising from the use of the Site that cannot be resolved directly will be submitted to mediation before a legally recognized mediation center in the applicable jurisdiction.
